1. Unofficial Application
Hello # (“the App”) is an independent, third-party application. It is not developed, endorsed, affiliated with, or supported by smart Europe GmbH or any of its subsidiaries. All vehicle trademarks belong to their respective owners.
2. Acceptance of Terms
By downloading, installing, or using the App, you agree to these Terms and Conditions. If you do not agree, you must uninstall the App and discontinue use immediately.
3. Use at Your Own Risk
The App communicates with your vehicle through smart Europe GmbH’s official APIs and services. However, these APIs are not officially documented or sanctioned for third-party use. You acknowledge and accept that:
• You use the App entirely at your own risk.
• The App may cause unexpected behavior with your vehicle, including but not limited to locking, unlocking, digital key provisioning, or other vehicle functions.
• You are solely responsible for any consequences arising from your use of the App.
4. No Warranty
The App is provided on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. The developer does not warrant that:
• The App will function uninterrupted, securely, or error-free.
• The results obtained from using the App will be accurate or reliable.
• Any defects will be corrected.
5. Limitation of Liability
To the maximum extent permitted by applicable law, the developer of Hello # shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to:
• Damage to or loss of your vehicle or any property.
• Unauthorized access to your vehicle.
• Loss or deactivation of digital keys, physical keys, or any other means of vehicle access.
• Personal injury or harm.
• Loss of data, revenue, or profits.
• Any damages arising from the use or inability to use the App.
This limitation applies regardless of the legal theory under which damages are sought, even if the developer has been advised of the possibility of such damages.
6. Irreversible and Destructive Actions
The App contains features that perform irreversible operations on your vehicle’s configuration through smart Europe GmbH’s servers. These include, but are not limited to, deleting digital keys. You acknowledge that:
• Such actions may have consequences beyond what is described, including the potential deactivation of physical keys or other vehicle access methods.
• The developer has no control over how smart Europe GmbH’s servers process these requests and cannot reverse their effects.
• You are solely responsible for understanding the consequences before performing any destructive action.
• The developer is not responsible for any loss of vehicle access resulting from actions you initiate through the App.
7. Digital Key & Vehicle Control
The Digital Key and any remote vehicle control features are provided for convenience only. You acknowledge that:
• These features rely on Bluetooth, network connectivity, and smart Europe GmbH’s services, which may fail or become unavailable at any time.
• The developer is not responsible for any failure to lock, unlock, or otherwise control your vehicle.
• You should always carry your physical key or official means of vehicle access as a backup.
• You must never rely solely on the App for vehicle security.
8. smart Europe GmbH Services
The App relies on smart Europe GmbH’s APIs and cloud services, which are outside the developer’s control. These services may change, become unavailable, or be discontinued at any time without notice. The developer is not responsible for any disruption caused by changes to these services.
9. Account Credentials
Your smart account credentials are stored securely on your device and are used solely to authenticate with smart’s services on your behalf. The developer does not collect, store, or have access to your credentials on any server. You are responsible for maintaining the confidentiality of your account.
10. Updates and Changes
The developer reserves the right to modify, update, or discontinue the App at any time without prior notice. These Terms may be updated from time to time. Continued use of the App after changes constitutes acceptance of the revised Terms.
11. Indemnification
You agree to indemnify and hold harmless the developer from any claims, damages, losses, or expenses (including legal fees) arising from your use of the App or violation of these Terms.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of France. You agree that any disputes shall be subject to the exclusive jurisdiction of the courts of France, regardless of your country of residence.
13. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
